Dance On Time, LLC - Custom Portable Dance Floor Rental

PLEASE READ CAREFULLY BEFORE YOUR EVENT

This Release of Liability Waiver (“Waiver”) is entered into as of the date of service between Dance On Time, LLC (“Company”) and the individual(s)/organization listed below (“Participant” or “Participants”).

1. ACKNOWLEDGMENT OF RISKS

Participant acknowledges that the rental and use of a custom portable dance floor (“Dance Floor Rental”) involves inherent risks, including but not limited to:

• Falls on or around the dance floor
• Slipping due to improper footwear or floor conditions
• Collisions with other dancers
• Tripping on dance floor edges or cables
• Equipment-related injuries during setup or breakdown
• Injuries from improper use or abuse of the floor
• Pre-existing conditions being aggravated by dancing or physical activity
• Injuries from crowding or overcrowding on the floor

2. FLOOR SPECIFICATIONS AND PROPER USE

Participant acknowledges and agrees that:

• The dance floor is professional-grade equipment designed for dancing
• The floor has a specific weight capacity (as specified in rental contract)
• The floor must be used only for its intended purpose (dancing)
• No furniture, equipment, or excessive weight should be placed on the floor
• The floor should not be used as a stage for activities other than dancing
• High heels and hard-soled shoes may cause damage and are not recommended
• The floor must remain level and secure throughout the event

3. FOOTWEAR AND FLOOR MAINTENANCE

Participant is responsible for:

• Recommending appropriate footwear to all guests (soft-soled, dancing shoes)
• Keeping the floor clean and free of debris, spills, and hazards
• Monitoring the floor condition throughout the event
• Preventing excessive moisture or liquid from accumulating on the floor
• Notifying Dance On Time, LLC immediately of any damage or unsafe conditions
• Preventing guests from wearing outdoor shoes or street footwear on the floor

4. ASSUMPTION OF RISK

Participant voluntarily assumes all risks associated with Dance Floor Rental, whether known or unknown, foreseen or unforeseen.

Participant represents that they:

• Are capable of safely managing a dance floor at their event
• Will ensure all attendees understand proper floor usage
• Will maintain safe conditions and adequate space around the floor
• Will monitor the floor and attendees for safety
• Understand that dancing on any floor carries inherent injury risk

5. RELEASE AND WAIVER

Participant, on behalf of themselves, their heirs, executors, administrators, assigns, and successors, hereby releases and forever waives any and all claims, demands, causes of action, and liabilities against:

• Dance On Time, LLC, its owners, operators, and employees
• Setup and breakdown personnel
• Equipment manufacturers and vendors
• The venue or property owner
• Event attendees and co-sponsors
• Any other parties involved in providing Dance Floor Rental

This waiver applies to all claims arising from or related to Dance Floor Rental, including but not limited to claims for personal injury, property damage, or emotional distress, caused by negligence or otherwise.

6. INDEMNIFICATION

Participant agrees to indemnify and hold harmless Dance On Time, LLC, its owners, operators, employees, and agents from any and all claims, damages, liabilities, costs, and expenses (including legal fees) arising from:

• Use of the rental dance floor at Participant’s event
• Falls, slips, or other injuries on or around the dance floor
• Damage to the dance floor caused by attendee actions or improper use
• Injuries to event attendees related to the dance floor
• Damage to venue or property caused by floor installation or removal
• Participant’s failure to follow safety protocols or usage guidelines

7. DAMAGE LIABILITY

Participant is liable for:

• Any damage to the dance floor beyond normal wear and tear
• Damage caused by improper use, abuse, or misuse
• Damage caused by excessive weight or pressure on the floor
• Damage caused by liquid spills, staining, or moisture exposure
• Damage caused by incorrect setup, storage, or handling
• Replacement or repair costs for damaged equipment

Dance On Time, LLC retains the right to charge for repairs or replacement based on damage assessment.

8. SETUP AND BREAKDOWN

Participant acknowledges that:

• Dance On Time, LLC personnel will handle professional setup and breakdown
• The venue must provide adequate space and access for setup/breakdown
• Participant is responsible for clearing the area of obstacles and hazards
• Setup takes approximately 2-4 hours depending on floor size
• Breakdown takes approximately 1-2 hours
• Dance On Time, LLC will determine safe setup conditions
• Participant must allow Dance On Time, LLC personnel full access during setup/breakdown times

9. VENUE RESPONSIBILITY

Participant is responsible for:

• Providing a safe, level venue suitable for floor installation
• Ensuring adequate clearance around the floor (minimum 2 feet)
• Protecting the floor from outdoor elements if placed outdoors
• Securing the event area to prevent unauthorized access
• Providing adequate lighting for safe dancing
• Maintaining emergency exits and pathways
• Preventing overcrowding on the floor

10. ATTENDEE SAFETY

Participant agrees to:

• Notify all attendees about proper floor usage and safety
• Monitor the dance floor during the event
• Ensure adequate spacing to prevent overcrowding
• Encourage proper footwear
• Watch for unsafe behavior or slipping hazards
• Request immediate assistance from venue staff if injuries occur

11. EQUIPMENT CONDITION AND INSURANCE

• Dance On Time, LLC will inspect the floor before delivery for existing damage
• Participant is responsible for the floor’s condition during the rental period
• Participant’s event liability insurance should cover injuries and damage
• Dance On Time, LLC carries insurance for equipment only, not event-related injuries
• Participant is advised to obtain event liability insurance

12. CANCELLATION AND WEATHER

Participant acknowledges that:

• Cancellations must be made within the specified timeframe per rental contract
• Refund policy applies per the signed rental agreement
• Outdoor installations may be cancelled or delayed due to weather
• Rain, extreme heat, or other weather may affect floor safety
• Dance On Time, LLC reserves the right to cancel if conditions are unsafe

13. MEDICAL EMERGENCY

Participant authorizes Dance On Time, LLC to contact emergency medical services (911) if anyone at the event becomes injured. Participant agrees to pay all costs associated with emergency medical treatment and transportation.

14. GOVERNING LAW

This Waiver shall be governed by and construed in accordance with the laws of the State of Georgia.

ACKNOWLEDGMENT

I HAVE CAREFULLY READ THIS RELEASE OF LIABILITY WAIVER. I FULLY UNDERSTAND AND ACCEPT ALL THE TERMS AND CONDITIONS. I VOLUNTARILY ASSUME ALL RISKS ASSOCIATED WITH DANCE FLOOR RENTAL AND AGREE TO MAINTAIN SAFE CONDITIONS FOR ALL EVENT ATTENDEES.
