Dance On Time, LLC - DJ Services

PLEASE READ CAREFULLY BEFORE YOUR EVENT

This Release of Liability Waiver (“Waiver”) is entered into as of the date of service between Dance On Time, LLC (“Company”) and the individual(s)/organization listed below (“Participant” or “Participants”).

1. ACKNOWLEDGMENT OF RISKS

Participant acknowledges that the use of DJ services, sound equipment, and lighting systems (“DJ Services”) involves inherent risks, including but not limited to:

• Exposure to amplified sound that may cause temporary or permanent hearing damage
• Exposure to strobing or rapidly changing lighting effects that may trigger seizures or disorientation
• Tripping hazards from sound equipment, cables, or stage setup
• Falls in low-light conditions created by lighting effects
• Physical collisions with equipment or other event attendees
• Equipment malfunction or failure
• Temporary disorientation from combined audio/visual effects

2. HEARING PROTECTION

Participant acknowledges that:

• DJ Services involve amplified sound at event-appropriate levels
• Prolonged exposure to amplified sound can cause hearing damage
• Participant may request ear protection or reduced volume levels
• Participant is responsible for protecting their own hearing and that of attendees
• Participant assumes all risk of hearing damage from sound exposure

3. SEIZURE WARNING

Participant acknowledges that DJ Services may include strobing, flashing, or rapidly changing lighting effects.

Participant represents that:

• They are not subject to seizures triggered by flashing or strobing lights
• They have disclosed any photosensitive epilepsy or light-sensitive conditions to Dance On Time, LLC prior to the event
• They will inform Dance On Time, LLC immediately if any attendee experiences symptoms of a seizure

4. ASSUMPTION OF RISK

Participant voluntarily assumes all risks associated with DJ Services, whether known or unknown, foreseen or unforeseen.

Participant represents that they are capable of safely managing an event where these services are provided, including maintaining safe conditions for all attendees.

5. RELEASE AND WAIVER

Participant, on behalf of themselves, their heirs, executors, administrators, assigns, and successors, hereby releases and forever waives any and all claims, demands, causes of action, and liabilities against:

• Dance On Time, LLC, its owners, operators, and employees
• DJ personnel and sound technicians
• Equipment manufacturers and vendors
• The venue or location where DJ Services are provided
• Event attendees and co-sponsors
• Any other parties involved in providing DJ Services

This waiver applies to all claims arising from or related to DJ Services, including but not limited to claims for personal injury (including hearing damage or seizures), property damage, or emotional distress, caused by negligence or otherwise.

6. INDEMNIFICATION

Participant agrees to indemnify and hold harmless Dance On Time, LLC, its owners, operators, employees, and agents from any and all claims, damages, liabilities, costs, and expenses (including legal fees) arising from:

• The use of DJ Services at Participant’s event
• Hearing damage or injury to event attendees
• Seizures or injuries triggered by lighting effects
• Injuries or incidents at the event involving DJ equipment or personnel
• Participant’s violation of any agreements or safety protocols

7. EQUIPMENT AND VENUE RESPONSIBILITY

Participant is responsible for:

• Providing adequate, safe space for DJ equipment setup
• Ensuring the venue can safely accommodate sound and lighting equipment
• Securing the event premises and controlling attendee access to DJ equipment
• Notifying Dance On Time, LLC of any venue restrictions or limitations
• Providing clear pathways and emergency exits
• Maintaining adequate lighting for safety when DJ lighting is off

8. ATTENDEE SAFETY

Participant acknowledges that they are responsible for:

• The safety and conduct of all event attendees
• Notifying attendees of potential hearing and lighting effects
• Providing seizure warnings to attendees when strobing lights will be used
• Monitoring attendees for signs of distress or injury
• Providing first aid or emergency services as needed

9. EQUIPMENT LIABILITY

Dance On Time is not responsible for:

• Damage to venue or property during setup or breakdown
• Loss, theft, or damage to attendee personal property
• Equipment malfunction or failure beyond Dance On Time’s control
• Power outages or interruptions to DJ Services

10. MEDICAL EMERGENCY

Participant authorizes Dance On Time, LLC to contact emergency medical services (911) if anyone at the event becomes injured or incapacitated. Participant agrees to pay all costs associated with emergency medical treatment and transportation.

11. CANCELLATION AND REFUNDS

Participant acknowledges that:

• Cancellations must be made within the specified timeframe per contract
• Refunds are subject to the cancellation policy agreed upon
• Dance On Time, LLC may cancel if venue conditions are unsafe
• Force majeure events may affect DJ Services availability

12. GOVERNING LAW

This Waiver shall be governed by and construed in accordance with the laws of the State of Georgia.

ACKNOWLEDGMENT

I HAVE CAREFULLY READ THIS RELEASE OF LIABILITY WAIVER. I FULLY UNDERSTAND AND ACCEPT ALL THE TERMS AND CONDITIONS. I VOLUNTARILY ASSUME ALL RISKS ASSOCIATED WITH DJ SERVICES AND AGREE TO MAINTAIN SAFE CONDITIONS FOR ALL EVENT ATTENDEES.
