Dance On Time, LLC - Dance Instruction Services

PLEASE READ CAREFULLY BEFORE PARTICIPATING

This Release of Liability Waiver (“Waiver”) is entered into as of the date of service between Dance On Time, LLC (“Company”) and the individual(s) listed below (“Participant” or “Participants”).

1. ACKNOWLEDGMENT OF RISKS

Participant acknowledges that participation in dance instruction classes and private lessons (“Dance Instruction Services”) involves inherent physical risks, including but not limited to:

• Physical exertion and cardiovascular stress
• Muscle strains, sprains, and other soft tissue injuries
• Joint injuries (ankles, knees, hips, shoulders, wrists)
• Falls and collisions with other participants
• Back injuries or spinal strain
• Overexertion and fatigue-related injuries
• Pre-existing conditions being aggravated by physical activity

2. ASSUMPTION OF RISK

Participant voluntarily assumes all risks associated with participation in Dance Instruction Services, whether known or unknown.

Participant represents that:

• They are in good physical health and capable of safely participating in dance activities
• They have disclosed any medical conditions, injuries, or physical limitations to Dance On Time, LLC
• They have not been advised by a medical professional to avoid dancing or strenuous activity
• They are not under the influence of alcohol, drugs, or substances that impair judgment or coordination
• They will inform the instructor immediately of any pain, discomfort, or unusual symptoms during class

3. MEDICAL CLEARANCE

If Participant has any of the following conditions, they represent that they have obtained written medical clearance from a physician before participating:

• Recent surgery or injury
• Heart conditions or high blood pressure
• Joint or bone problems
• Pregnancy
• Balance or inner ear disorders
• Any other chronic or acute medical condition

4. RELEASE AND WAIVER

Participant, on behalf of themselves and their heirs, executors, administrators, assigns, and successors, hereby releases and forever waives any and all claims, demands, causes of action, and liabilities against:

• Dance On Time, LLC, its owners, operators, instructors, and employees
• The studio location and property owners
• Co-participants and other class members
• Any other parties involved in providing Dance Instruction Services

This waiver applies to all claims arising from or related to Participant’s participation in dance instruction, including but not limited to claims for personal injury, property damage, or emotional distress, caused by negligence or otherwise.

5. INDEMNIFICATION

Participant agrees to indemnify and hold harmless Dance On Time, LLC, its owners, operators, instructors, employees, and agents from any and all claims, damages, liabilities, costs, and expenses (including legal fees) arising from:

• Participant’s participation in Dance Instruction Services
• Participant’s violation of safety rules or class guidelines
• Participant’s negligence or willful misconduct
• Injury to Participant or third parties caused by Participant’s actions

6. INSTRUCTOR AUTHORITY

Participant acknowledges that the dance instructor has the authority to:

• Stop Participant’s participation if they deem it unsafe
• Modify or restrict Participant’s movements based on physical limitations
• Ask Participant to sit out or leave class if they appear injured or unwell
• Recommend that Participant seek medical attention

Participant agrees to comply with all instructor directives without argument or delay.

7. PERSONAL RESPONSIBILITY

Participant is responsible for:

• Using proper footwear suitable for dancing
• Staying hydrated during class
• Monitoring their own physical limitations and pain levels
• Communicating with the instructor about any concerns
• Not pushing through severe pain or discomfort
• Arriving on time and following all class protocols

8. MEDICAL EMERGENCY

Participant authorizes Dance On Time, LLC personnel to contact emergency medical services (911) if Participant becomes injured or incapacitated. Participant agrees to pay all costs associated with emergency medical treatment and transportation.

9. PHOTOGRAPHS AND VIDEO

Participant consents to the taking of photographs and/or video recordings by Dance On Time, LLC for instructional, promotional, or archival purposes. Participant grants Dance On Time, LLC the right to use these images and videos without further compensation or notification.

10. NO WARRANTY

Dance On Time, LLC makes no representations or warranties regarding Dance Instruction Services, including fitness for a particular purpose or specific results. Services are provided on an “as-is” basis.

11. GOVERNING LAW

This Waiver shall be governed by and construed in accordance with the laws of the State of Georgia.

ACKNOWLEDGMENT

I HAVE CAREFULLY READ THIS RELEASE OF LIABILITY WAIVER. I FULLY UNDERSTAND AND ACCEPT ALL THE TERMS AND CONDITIONS. I VOLUNTARILY ASSUME ALL RISKS ASSOCIATED WITH MY PARTICIPATION IN DANCE INSTRUCTION SERVICES.
